TITLE:                     Ordinance Nos. 2018-23 (TXT-18-034) and 2018-24 (TXT-18-097), Second Readings. Amending ULDC Chapter 25-Parking and Loading Regulations and Chapter 53-Zoning Regulations related to parking and storage of certain vehicles

 

 

Recommended Action

The Planning and Zoning Advisory Board recommends that the Commission approve the proposed amendments to the Unified Land Development Code as shown in Ordinance Nos. 2018-23 and 2018-24.

Summary of Commission-Directed Revisions to Ordinance No. 2018-23

At the September 11, 2018 hearing on the first reading of the ordinances, the Commission directed staff to do the following:

1.                     Remove requirement for additional parking to accommodate additional demand for parking due to the new allowance for outside storage of vehicles as an accessory use where mini-storage/ warehousing is allowed as the principal use.

2.                     Add cross-references to City Code Chapters 59 and 74 in AG District-Section 53-35 Parking requirements; RMF District-Section 53-157 Parking requirements; and AC Design Regulations-Section 55-8 Parking requirements.

3.                     Confer with the Assistant City Attorney regarding the language in Section 53-240 Special Structures, (T) Modular/manufactured homes and recreational vehicles, and whether it is all still necessary given the recent ordinance adopting revisions to the City Code regarding parking and storage of vehicles on residential lots.

The following was discussed and addressed in a different way:

4.                     Sec. 25-19 was repealed in its entirety and "reserved" for future amendments. A suggestion was made to retain the section and use it to refer to City Code Chapters 59 and 74. Staff searched for any remaining references to Section 25-19 elsewhere in the ULDC and found none. In lieu of adding a cross reference in this section, one was added to the GENERAL REFERENCES at the beginning of Chapter 25.

Background Information

At a workshop on January 4, 2018, the Commission directed staff to present text amendments that move some parking regulations pertaining to residential lots from the ULDC to the City Code, and other ULDC text amendments that allow outdoor storage of vehicles in areas that permit mini-storage/warehousing facilities.

The City Code amendments are being addressed through Ordinance No. 2018-09, which creates Chapter 59-Property Standards including Section 59-16-Parking and Storage of Certain Vehicles on Residential Lots, and amends Chapter 74-Traffic and Vehicles, Sections 74-84, 74-85 and 74-92-Storage of Certain Vehicles. Two Commission hearings were held for the first reading of the Ordinance on May 22 and June 7, 2018. The next public hearing on that ordinance is also scheduled for September 11.

On June 21, 2018, the Planning and Zoning Advisory Board held a public hearing on Ordinance Nos. 2018-23 and 2018-24, deliberated, and voted to recommend that the Commission adopt the two ordinances.

On September 11, 2018, the Commission held a public hearing and directed staff to make some specific revisions that would be adopted at the second reading. See Summary above and Exhibit A for more details.

The proposed ULDC amendments can be summarized as follows:

1.                     Repealing Chapter 25, Section 25-19-Parking & Storage of Certain Vehicles: This entire section would be repealed and addressed through new sections in the City Code to be adopted by Ordinance No. 2018-09.

2.                     Citing the New City Code Regulations for Parking and Storage of Vehicles on Residential Lots: All sections of the ULDC that refer to the residential parking and loading requirements in Chapter 25 will now also include “For additional regulations pertaining to parking and vehicle storage on residential lots, see Chapters 59 and 74 of the Code of the City of North Port, Florida.”  or similar language.

3.                     Allowing Outdoor Storage of Vehicles as an Accessory Use with Mini-Storage/Warehousing Uses (Exhibit B-Ord #2018-24): In zoning districts that allow Mini-Storage (ILW, CG-AC #4 & #6 only) or Mini-Warehouse (ILW-Trott Circle only) facilities, the ULDC sections refer to Section 53-240. Special Structures. S. Mini storage facilities and mini warehousing for additional requirements, which is the section where the language for prohibiting outside storage currently exists.
