TITLE: Approval of Third Amendment to Agreement No. 2017-40, Professional Design and Engineering Services for Warm Mineral Springs Park Master Plan, to Kimley-Horn & Associates, Inc., in the Amount of $692,800 to Provide Construction Plans and Documents to Facilitate a Trail Connection from Warm Mineral Springs Park to the North Port Connector of the Legacy Trail.
Recommended Action
Approval of Third Amendment to Agreement No. 2017-40, Professional Design and Engineering Services for Warm Mineral Springs Park Master Plan, to Kimley-Horn & Associates, Inc., in the amount of $692,800.00, to provide construction plans and documents to facilitate a trail connection from Warm Mineral Springs Park to the North Port Connector of the Legacy Trail.
Background Information
During the January 28, 2025, City Commission Regular Meeting, Ordinance No. 2025-01 was approved on second reading amending the non-district budget and capital improvement budget for fiscal year 2024-2025. Included in Ordinance No. 2025-01 was $500,000 in Park Impact Fee funding to support Capital Improvement Project No. P24LTC Legacy Trail Connection to Warm Mineral Springs. With this funding in place, and the consolidation of funding from Project No. P22DPB Legacy Trail Extension Parking Enhancements, Project No. P24LTC is now fully funded to support professional design and engineering services for the development of a trailhead facility and multi-use trail connecting Warm Mineral Springs Park to the North Port Connector of the Legacy Trail.
The Third Amendment to Agreement No. 2017-40, Professional Design and Engineering Services for Warm Mineral Springs Park Master Plan is specific to development of the construction documents for a trailhead facility and trail connection from Warm Mineral Springs Park to the North Port Connector of the Legacy Trail at Calera Street and West Price Boulevard. The 1.7-mile trail extension is part of the regional Sun Trail network and is also a component of the broader Florida Gulf Coast Trail, which when fully realized will be one of the longest continuous trails (420 miles) in Florida traversing seven counties from Tampa to Naples. The trail not only supports safe pathways for outdoor recreation, but also expands access to nature, fosters health and well-being, attracts residents and tourists, and stimulates economic opportunities.
The following provides a chronological order of the amendments associated with Agreement No. 2017-40, Professional Design and Engineering Services for the Warm Mineral Springs Park Master Plan:
Ø April 5, 2018: During the City Commission Special Meeting, Agreement No. 2017-40, Professional Design and Engineering Services for the Warm Mineral Springs Park Master Plan with Kimley-Horn and Associates was approved for the development of a Master Plan document for Warm Mineral Springs Park and associated improvements within the 80-acre site. The Final Warm Mineral Springs Park Master Plan was adopted on April 19, 2019.
Ø February 25, 2020: During the City Commission Regular Meeting, the First Amendment to Agreement No. 2017-40 for Professional Design and Engineering Services for Warm Mineral Springs Park Master Plan with Kimley-Horn and Associates, Inc. was approved to develop construction and permitting documents for historic restoration of the existing buildings and utility infrastructure improvements. Request for Bid No. 2022-22 Warm Mineral Spring Park Building Restoration & Improvements was released on April 20, 2022, and closed on June 6, 2022. A single bid was received in response which far exceeded the available project budget. As a result, the City issued a Notice of Intent to cancel the solicitation and rebid at a later date.
Ø February 25, 2025: During the City Commission Regular Meeting, the Second Amendment to Agreement No. 2017-40 for Professional Design and Engineering Services for Warm Mineral Springs Park Master Plan with Kimley-Horn and Associates, Inc. was approved to facilitate a hybrid renovation of the historic buildings and utility infrastructure improvements. This work is currently in progress.
This project has garnered support from key organizations such as the Gulf Coast Community Foundation, Trust for Public Lands, and Friends of the Legacy Trail. Furthermore, the Sarasota-Manatee Metropolitan Planning Organization has identified this trail connection as a priority project within the Sun Trail network for the region. Completing the design and having a shovel-ready project significantly enhances eligibility for construction grant opportunities. To that end, staff from the Parks & Recreation Department and the Grants Division have submitted construction grant applications to the federally funded Recreational Trails Program, in the amount of $450,000 and the state funded Sun Trail Grant Program, in the amount of $3,730,000.
The Third Amendment to Agreement 2017-40, Professional Design and Engineering Services for Warm Mineral Springs Park Master Plan, to Kimley-Horn & Associates, Inc., has been reviewed by the Interim City Attorney and is legally correct as to form.
