Background Information

Tony Squitieri, for Forestar Group on behalf of HMTA Real Estate LLC has formally submitted a Comprehensive Plan Amendment for the ± 83-acre site with a Future Land Use of Agricultural, Estates, and Activity Center. The Future Land Use of the subject parcel is encroached upon by Activity Center 4. The Activity Center 4 boundaries encroach on an approximate 500,000 square feet portion of the subject parcel.

Pursuant to Florida Statutes Chapter 163.3184(3), since the development is greater than 10 acres, the expedited state review process applies. This process requires that the amendment be transmitted to the State within 10 days from the initial public hearing, sets out the agencies who must receive the review, as well as establishing procedures to follow after the second public hearing.

A legal notice of intent to amend the comprehensive plan was published by the City of North Port in a newspaper of general circulation, August 2, 2022.

The City Attorney has reviewed the accompanying Ordinance 2022-22 as to form and correctness.

At the regularly scheduled meeting of August 18, 2022, the Planning and Zoning Advisory Board voted 3-0 to recommend that the City Commission approves Ordinance No. 2022-22. The Board found that the amendment is consistent with the standards and intent of the adopted Comprehensive Plan and Florida Statutes.
