TITLE: Approve the Ratification of Emergency Orders No. 2022-05 Terminating Emergency Order No. 2022-04; No. 2022-06 Relating to Extension of Business Tax Receipts; No. 2022-07 Relating to Waiver of Water and Wastewater Late Fees; No. 2022-08 Relating to Temporary Business Signs; No. 2022-09 Relating to Suspension of Time Limitations for Living or Camping in Vehicles on Residential Lots; No. 2022-10 Relating to the Temporary Reduction of Members Required to Constitute a Quorum for the Zoning Board of Appeals; and No. 2022-11 Amending Emergency Order No. 2022-10.
Recommended Action
Approve the ratification of Emergency Orders No. 2022-05 Terminating Emergency Order No. 2022-04; No. 2022-06 Relating to Extension of Business Tax Receipts; No. 2022-07 Relating to Waiver of Water and Wastewater Late Fees; No. 2022-08 Relating to Temporary Business Signs; No. 2022-09 Relating to Suspension of Time Limitations for Living or Camping in Vehicles on Residential Lots; No. 2022-10 Relating to the Temporary Reduction of Members Required to Constitute a Quorum for the Zoning Board of Appeals; and No. 2022-11 Amending Emergency Order No. 2022-10.
Background Information
On September 23, 2022, Florida Governor Ron DeSantis issued Executive Order Number 22-218, declaring a that a state of emergency exists in 24 Florida counties to include Sarasota County due to Tropical Depression Number Nine. On September 24, 2022, Governor DeSantis issued Executive Order 22-219 Amending Executive Order 22-218 to expanding the state of emergency to the State of Florida.
Subsequently on September 26, 2022, the Commission of the City of North Port met during an Emergency Meeting and adopted Ordinance 2022-30, declaring a local state of emergency in the City of North Port, granting emergency authority to the City Manager to issue Emergency Orders to ensure the safe conduct of necessary operations of the North Port City Government. The emergency authority granted to the City Manager during this state of emergency may extend beyond normal non-emergency powers. As the following Emergency Orders extend beyond his normal scope of authority, the City Manager requests that they be ratified by the City Commission:
• Emergency Order No. 2022-05 Terminating Emergency Order No. 2022-04
• Emergency Order No. 2022-06 Relating to Extension of Business Tax Receipts
• Emergency Order No. 2022-07 Relating to Waiver of Water and Wastewater Late Fees
• Emergency Order No. 2022-08 Relating to Temporary Business Signs
• Emergency Order No. 2022-09 Relating to Suspension of Time Limitations for Living or Camping in Vehicles on Residential Lots
• Emergency Order No. 2022-10 Relating to the Temporary Reduction of Members Required to Constitute a Quorum for the Zoning Board of Appeals
• Emergency Order No. 2022-11 Amending Emergency Order No. 2022-10
Each of the subject Emergency Orders was prepared by the City Attorney for the City Manager’s execution.
