General Information
The proposed ordinance amends the Comprehensive Plan of the City of North Port to create a separate coastal management element and map series, revises the conservation element, and other elements to eliminate conflict. The proposed amendments also include the addition of permitted uses of solar facility and floating solar facility in certain land use districts
Coastal zone management is currently addressed in North Port Comprehensive Plan Chapter 5, Conservation and Coastal Zone Management. A new Comprehensive Plan Chapter 13 to include the Coastal Management element required by Florida Statutes Section 163.3177(6)(g) is proposed along with an update of the goals, objectives, and policies to address the peril of flood pursuant to Florida Statutes Section 163.3178(2)(f)1 through 6; and
Chapter 5, Conservation and Coastal Zone Management element is amended to repeal those provisions to be addressed in Chapter 13, Coastal Management. Chapter 2, Future Land Use Element, Chapter 4, Utilities, and Chapter 9, Public Schools Facilities are amended to update references to Chapter 5 and eliminate associated conflicts.
In addition, this ordinance proposed to amend the Comprehensive Plan, Chapter 2, Future Land Use Element to permit solar facilities in the Agricultural Estates future land use district and zoning district and to permit floating solar facilities (floatovoltaics) in the Agricultural Estates, Public, Industrial, and Utility/Industrial Corridor future land use pursuant to Florida Statutes Sections 163.3205 and 163.32051.
The City Attorney has reviewed and approved Ordinance 2022-31 as to form and correctness.
The petition was advertised in a newspaper of general circulation within the City of North Port on November 1, 2022, pursuant to the provisions of Section 166.041(3)(a), Florida Statutes and Section 7.01(c) of the Charter of the City of North Port, and the City of North Port Unified Land Development Code Chapter 1 - General Provisions, Article II. - Administration of Unified Land Development Code, Section 1-12. - Amendments., as amended.
The Planning and Zoning Advisory Board considered this amendment on November 17, 2022 and voted unanimously to recommend that the City Commission approve Ordinance No. 2022-31.
Information for Second Reading
On November 22, 2022, the City Commission considered this amendment on first reading and motioned by consensus to include the reference to flood zones A, AE and VE in Policy 2.10, which change is included in the ordinance prepared for transmittal and second reading.
This Comprehensive Plan Amendment was transmitted to the State of Florida Department of Economic Opportunity (DEO) for Expedited State Review following the first reading. On December 28, 2022, DEO notified the City that their review was complete and they have no comments on the proposed amendment.
