                     Pros: Approval of Resolution No. 2025-R-86 will grant necessary easements for Florida Power & Light (FPL) access to City property for the relocation of their existing infrastructure in accordance with the design for the demolition and construction Fire Station 81 located at 4980 City Center Boulevard.

                     Cons:  The comprehensive staff analysis concluded that there are no identifiable drawbacks to the approval of Resolution No. 2025-R-86.

 

Option 2: Deny Resolution No. 2025-R-86 as presented.

 

                     Pros: The comprehensive staff analysis concluded that there are no identifiable pros to the denial of Resolution No. 2025-R-86.

                     Cons: Denial will prevent FPL access for the relocation of existing power infrastructure in accordance with the project design, delaying the project and creating additional expense by having to work around the existing power infrastructure.

 

Background Information

 

During the City Commission Regular Meeting held on June 24, 2025, the Commission approved the Second Amendment to Construction Manager at Risk Contract No. 2023-07 for Phase II services with Wharton Smith for the demolition and construction of Fire Station 81.  As part of the demolition and construction project, the underground power lines need to be relocated to provide for the new parking lot improvements.

 

Resolution No. 2025-R-86 grants the necessary easement for FPL to access the property for installation and maintenance, and repair of infrastructure installed on the property, whether above or below ground level.  Additionally, the Resolution approves the necessary FPL Underground Distribution Facilities Installation Agreement, Underground Road/Pavement Crossing Agreement, and Transformer Pad Location and Specification. The existing easement for the existing transformer and infrastructure will be vacated once the new easement and service are in place.

 

Under the terms of the Underground Distribution Facilities Installation Agreement, the City will pay a Contribution in Aid of Construction in the amount of $41,888 to cover the differential cost between an underground and overhead system.  The City may receive a credit of up to $27,606.88 for trenching, backfilling, installation of City provided conduit and other work, as applicable, resulting in a contribution payment in the amount of $14,281.12.

 

Resolution No. 2025-R-86 has been reviewed by the City Attorney and is legally correct as to form.

 

Resolution No. 2025-R-86 was provided to the City Clerk’s Office on October 28, 2025, for signature subject to City Commission approval.

The amount of $41,888 has been budgeted in the CIP for this in expense in account no. 001-0760-519.62-00, Project F17R81.
